You are responsible for using this service lawfully and ethically. We provide the service as-is and are not liable for parenting decisions made based on our summaries.

1. Acceptance of Terms

By creating an account and using MyKidsDay ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account
You must be the legal parent or court-appointed guardian of any child you monitor
You may not use MyKidsDay to monitor anyone who is not your minor child
Using MyKidsDay to monitor adults, non-custodial children, or anyone without proper legal authority is strictly prohibited and may be illegal

3. Permitted Use

MyKidsDay is designed exclusively for:

Parents monitoring their own minor children (under 18)
Legal guardians monitoring their wards
Protecting children from online harm
Supporting healthy parent-child communication

4. Prohibited Use

You may not use MyKidsDay to:

Monitor any adult without their explicit consent
Monitor a child you do not have legal custody of
Stalk, harass, or surveil any person
Collect data for commercial purposes
Circumvent any technical protection measures
Violate any applicable federal, state, or local laws

5. Legal Responsibility

You are solely responsible for ensuring your use of MyKidsDay complies with all applicable laws in your jurisdiction. Laws regarding monitoring of minors vary by state and country. MyKidsDay is not responsible for any legal consequences arising from your use of the service.

In many US states, parents have broad legal authority to monitor their minor children's digital activity. However, we recommend consulting a legal professional if you have questions about your specific situation.

6. iCloud Credentials

If you choose to provide your child's Apple ID credentials:

You represent that you have the legal authority to provide these credentials
You accept full responsibility for any consequences of providing these credentials
We strongly recommend using Apple app-specific passwords rather than the primary Apple ID password
You may remove stored credentials at any time from your Settings page

7. Subscription and Billing

Free plan: available with limited features, no credit card required
Family plan: $9.99/month, billed monthly, cancel anytime
Cancellation takes effect at the end of the current billing period
No refunds for partial months except as required by law
We reserve the right to change pricing with 30 days notice to existing subscribers

8. Disclaimer of Warranties

MyKidsDay is provided "as is" without warranties of any kind. We do not guarantee:

100% accuracy of AI-generated summaries
Detection of all concerning activity
Uninterrupted or error-free service
That our summaries constitute professional mental health, legal, or medical advice

AI summaries are informational only. They are not a substitute for professional judgment. Always seek qualified professional help for serious concerns about your child's wellbeing.

9. Limitation of Liability

To the maximum extent permitted by law, MyKidsDay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

10. Privacy

Your use of MyKidsDay is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately and we will delete your data within 30 days.

12. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.

13. Changes to Terms

We will notify users of material changes via email at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
